Vacating Criminal Convictions in Washington

Although many states refer to clearly a criminal record as “expungement,” the correct term for removing your criminal history in Washington State is called “vacation.” When a person vacates a conviction, the court vacates the judgment and judgment/sentence, reverses the guilty plea, dismisses the charge, and removes the conviction from a person’s criminal history.

When it comes to felony convictions, a person can vacate most Class B and C felonies. However, Class A felonies, violent crimes, and crimes which directly harm an individual are not eligible for vacation. A person must obtain a Certificate of Discharge prior to vacating a felony conviction.

Individuals with misdemeanor convictions or gross misdemeanor convictions are also eligible for vacation. However, specific offenses such as DUIs and sex crimes are not eligible.

The following are the waiting periods for vacating a conviction:

  • Class B felony – 10 years
  • Class C felony – five years
  • Misdemeanor or gross misdemeanor – three years
  • Deferred judgment – two years

Eligible individuals cannot be convicted of a crime in this state, another state, or in federal court.
